By accessing or using MOTOWN AI, you confirm that you are at least 13 years of age and have the legal capacity to enter into a binding agreement under applicable law.

If you are accessing the platform on behalf of an educational institution or organization, you represent that you have the authority to bind that entity to these Terms.

By creating an account or using the platform, you agree to:

• Be bound by these Terms of Service
• Provide accurate and truthful account information
• Take full responsibility for all content you upload or share
• Comply with all applicable local, national, and international laws

We reserve the right to update these Terms at any time. Continued use of the platform after changes constitutes your acceptance of the revised Terms.

Ownership and Rights

You retain full ownership of the original content you create and upload to MOTOWN AI. By uploading content, you grant us a non-exclusive, royalty-free, worldwide license to host, display, and distribute your content solely for the purpose of operating the platform.

This license does not transfer ownership of your content to us. You may delete your content at any time, which will revoke this license. By uploading content, you represent that:

• You are the original creator of the content you upload, or have obtained all necessary permissions
• Your content does not infringe on the intellectual property rights of any third party
• You have the right to grant us the license described above

MOTOWN AI and its logos, design, and original content are protected by intellectual property laws and remain the sole property of the platform.

Content You Don't Own

To protect creators, institutions, and our community, the following content is strictly prohibited on MOTOWN AI.

Academic Copyright Violations

Uploading protected academic materials without permission is a serious breach of these Terms and applicable copyright law.

• Copyrighted textbooks — full or partial scans, PDFs, or digital copies of published works
• Commercial course materials — content from paid courses, subscriptions, or proprietary learning platforms
• Other users' content — study materials uploaded by other users that you do not have the rights to use or redistribute

You may upload your own lecture slides, notes, and materials you have created for personal study. The restrictions above apply to content you do not own or do not have rights to.

Harmful and Illegal Content

• Hate speech or discrimination — content that is hateful, discriminatory, or harassing toward any person or group
• Malware or malicious files — phishing links, spyware, or any file designed to harm users or systems
• Unauthorized personal data — sharing another person's private information without their explicit consent
• Illegal content — anything that violates applicable laws

Academic Dishonesty

• Submitting AI-generated work as your own — representing Motown AI outputs as original human-authored work in assessments
• Circumventing platform restrictions — attempting to bypass pricing, access controls, or moderation systems
• Redistributing purchased content — sharing, re-uploading, or reselling content you purchased for personal use

Violations may result in immediate content removal, account suspension, referral to your institution's academic integrity office, and potential legal proceedings under applicable law.

Indemnification

You agree to indemnify, defend, and hold harmless MOTOWN AI, its founders, officers, employees, partners, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses arising out of or related to:

• Your use of or access to the platform
• Content you upload, share, or transmit through the platform
• Your violation of these Terms of Service
• Your violation of any third-party rights, including intellectual property or privacy rights
• Any claim that your content caused damage to a third party

Notice-and-Takedown Policy

MOTOWN AI respects intellectual property rights. If you believe content on our platform infringes your copyright, submit a takedown notice with:

1. Your full name and contact information (email address and phone number)
2. A description of the copyrighted work you claim has been infringed
3. The specific URL or location of the infringing content
4. A statement of good faith belief the use is not authorized
5. A statement, under penalty of perjury, that the information is accurate
6. Your physical or electronic signature

Send takedown notices to: [email protected]. We aim to process valid requests within 5 to 10 business days. Users who repeatedly infringe copyright will have their accounts permanently suspended.

Content Moderation

MOTOWN AI employs a combination of automated tools and human review to moderate content. We reserve the right to:

• Review any content uploaded to the platform
• Remove content that violates these Terms without prior notice
• Suspend or permanently ban accounts that repeatedly violate our policies
• Report illegal content to appropriate law enforcement authorities
• Limit or restrict features for accounts under review

Content moderation decisions are final, though users may appeal by contacting our support team.

Disclaimers and Limitation of Liability

MOTOWN AI is provided on an "as is" and "as available" basis without warranties of any kind. We do not warrant that:

• The platform will be uninterrupted, error-free, or secure at all times
• AI-generated content (flashcards, quizzes, notes, summaries, podcasts) is accurate, complete, or reliable
• The platform will meet your specific educational or academic requirements

AI Content Disclaimer: MOTOWN AI uses artificial intelligence to generate study materials including flashcards, quizzes, notes, summaries, and podcasts. AI-generated content may contain errors, inaccuracies, or omissions. Always cross-reference with official course materials, textbooks, and consult your instructors. Never rely solely on AI-generated content for academic assessment preparation.

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable law.

1. Informal Resolution: Contact us at [email protected]. We will make good faith efforts to resolve within 30 days.
2. Mediation: If informal resolution fails, both parties agree to non-binding mediation before formal legal action.
3. Jurisdiction: Unresolved disputes shall be subject to the exclusive jurisdiction of the courts of competent jurisdiction in your location.

Paid Content Access

Certain documents and resources on MOTOWN AI may be offered for purchase. Paid content consists exclusively of original materials produced by the platform operator.

• Immediate Access: Upon successful payment confirmation via our third-party processor (Paystack), users are granted access to the purchased content through their account dashboard.
• Delivery Method: Purchased content is accessible through the user dashboard while the account remains in good standing. No physical goods are delivered under any circumstances.
• Access Duration: Purchased content remains accessible through your account unless your account is suspended or terminated for violation of these Terms.

If you do not receive access within 10 minutes of a confirmed payment, contact us at [email protected] with your payment reference number.

Payments and Fees

All transactions on MOTOWN AI are handled securely through our payment partner, Paystack. By making a purchase, you agree to the payment terms below.

Merchant of Record: All paid content on Motown AI is sold by Alan Focus Web Services, the sole operator and merchant of record for this platform. No other user, contributor, or third party is authorised to sell content through this platform.

• Pricing: All prices are listed in your local currency and are subject to change without prior notice. Prices are inclusive of applicable taxes unless stated otherwise.
• Payment Processing: All payments are processed securely by Paystack. MOTOWN AI does not store your credit card number, Mobile Money PIN, or any sensitive banking credentials on our servers.
• Currency: All transactions are processed in the currency displayed at checkout. Any currency conversion fees imposed by your bank or mobile money provider are your responsibility.

Security Notice: Motown AI staff will never ask you to share your PIN, password, or full card details via email, phone, or chat. Report any such requests to [email protected].

Refund and Cancellation Policy

• 14-Day Refund Window: You may request a full refund within 14 days of your purchase, no exceptions or conditions. Contact [email protected] with your payment reference.
• Cancel Anytime: You can cancel your subscription at any time from your account settings. Access continues until the end of your current billing period.
• Technical Failures: If a verified technical error prevents access to purchased content, we will resolve access within 48 hours. If the issue cannot be resolved, a full refund will be issued to the original payment method.

Academic Integrity and Personal Use

MOTOWN AI hosts two types of content. Understanding the difference is important for all users.

Community Content

Registered users may share original study notes, summaries, explanations, and AI-generated study aids with the community at no charge. Community content is subject to review and must comply with the Prohibited Content policy above. Community contributors do not receive payment.

Premium Content

Paid content available for purchase on Motown AI consists exclusively of original materials produced by Alan Focus Web Services, the platform operator. These are independently authored practice assessments, study resources, and materials created specifically for this platform.

Monetisation Restriction

The ability to set a price on content is restricted to platform administrators. General users may not sell, charge for, or receive payment in connection with content uploaded to MOTOWN AI. Attempting to circumvent this restriction constitutes a material breach of these Terms.

• Personal Use Only: Purchased content is licensed for individual, personal study only. Redistribution, public sharing, uploading to other platforms, or re-selling is strictly prohibited.
• Original Authorship: All paid content is the original intellectual property of Alan Focus Web Services. Community contributors retain ownership of their own work but grant the platform a display licence as described in the Ownership section.
• No Cheating: MOTOWN AI strictly prohibits using the platform to cheat on exams, plagiarise content, or misrepresent AI-generated work as your own. Violations may result in account termination.

Zero Tolerance: Any user found redistributing purchased content, circumventing pricing restrictions, or using the platform for academic dishonesty will have their account permanently banned and may face legal proceedings.
